These Terms and Conditions ("Terms") govern use of chitowntrolley.com and establish general conditions that may apply to transportation services provided by ChiTown Trolley ("ChiTown Trolley," "we," "us," or "our"). A specific quote, reservation confirmation, service agreement, invoice, or signed authorization may contain additional terms. If a signed or written reservation agreement conflicts with these Terms, the reservation-specific agreement controls for that reservation.

1. Website Use
The website provides general information about our vehicles and transportation services. Website content, photographs, availability statements, estimated travel times, and service descriptions are informational and may change. Using the website does not guarantee that a particular vehicle, date, route, or service is available.
2. Quotes and Reservation Requests
Submitting a quote request, contact form, or reservation request starts the booking process but does not by itself create a confirmed reservation. Unless a written quote or service agreement states otherwise, a reservation is considered secured only after ChiTown Trolley confirms the booking and receives the required deposit.
The customer is responsible for reviewing all quote and confirmation details, including service date, pickup time, locations, passenger count, vehicle type, service duration, and pricing, and for promptly notifying ChiTown Trolley of any errors or requested changes.
3. Deposit, Payment, and Credit Card Authorization
Unless otherwise stated in writing, a $100 deposit is required to secure a reservation. The remaining balance is due during the week of service. ChiTown Trolley may require a signed credit card authorization form or other payment authorization for the deposit, remaining balance, or other charges authorized under the reservation agreement.
By providing a payment method, the cardholder represents that they are authorized to use that payment method and authorizes ChiTown Trolley to process the amounts identified in the applicable quote, invoice, service agreement, or authorization.
For security, full payment card numbers and card-verification codes should be submitted only through the secure payment or authorization method designated by ChiTown Trolley and should not be sent through ordinary email, text messaging, or general website contact forms.
4. Pricing and Additional Charges
Pricing is based on the vehicle, date, service period, itinerary, mileage, locations, and other details stated in the quote or reservation. Additional time, additional stops, route changes, parking, tolls, venue access requirements, special requests, or other services not included in the original booking may result in additional charges when disclosed in the reservation agreement or approved by the customer.
5. Minimum Service Time
Unless otherwise confirmed in writing, private charters are subject to a three-hour minimum. Different minimums may apply to particular dates, vehicles, packages, or special events when stated in the written quote or reservation confirmation.
6. Itinerary and Schedule Changes
Customers should contact ChiTown Trolley at least 14 days before the service date to finalize or update the itinerary. Changes requested after that time are subject to vehicle availability, route feasibility, driver scheduling, venue restrictions, and any applicable additional charges.
Customers are responsible for providing accurate pickup and destination addresses, event times, contact information, and passenger counts. ChiTown Trolley may recommend schedule adjustments based on traffic patterns, loading time, event access, or other operational considerations.
7. Passenger Capacity and Vehicle Assignment
Passenger count may not exceed the lawful or stated capacity of the assigned vehicle. Vehicle descriptions and photographs are representative. The vehicle identified in the reservation confirmation is the intended vehicle; however, if an unexpected mechanical, safety, or operational issue occurs, ChiTown Trolley may make reasonable efforts to provide a comparable substitute when available.
8. Traffic, Weather, Delays, and Events Beyond Our Control
Chicago-area transportation can be affected by traffic, construction, road closures, weather, police activity, venue access, parades, sporting events, concerts, and other conditions outside our control. ChiTown Trolley will use reasonable efforts to follow the agreed itinerary and schedule, but exact travel or arrival times cannot be guaranteed when affected by circumstances beyond our reasonable control.
9. Passenger Conduct and Safety
Passengers must follow lawful instructions from the chauffeur and must not interfere with safe operation of the vehicle. Unlawful, threatening, abusive, destructive, or dangerously disruptive conduct may result in refusal or termination of service when reasonably necessary for safety. The customer is responsible for communicating applicable conduct expectations to their group.
10. Alcohol and BYOB Charters
For private charters where alcohol is permitted, only passengers who are 21 years of age or older may possess or consume alcoholic beverages, and all alcohol use must comply with applicable law and ChiTown Trolley safety rules. Kegs are not permitted. ChiTown Trolley may restrict or stop alcohol consumption when reasonably necessary for safety, legal compliance, or protection of the vehicle and passengers.
11. Decorations
Decorations such as florals, garlands, ribbons, and signs may be permitted when they can be installed and removed without damaging the vehicle. Customers may not use adhesives, fasteners, materials, or installation methods that cause damage. Decorations must not obstruct exits, windows, driver visibility, or safety equipment.
12. Cleaning, Damage, and Property
The customer may be responsible for reasonable repair, replacement, or extraordinary cleaning costs caused by the customer or members of the customer's party, to the extent stated in the reservation agreement and permitted by law. Passengers should remove personal belongings at the end of service. ChiTown Trolley is not responsible for lost or unattended property except to the extent required by applicable law.
13. Cancellations, Rescheduling, and Refunds
Cancellation, rescheduling, deposit, and refund terms are governed by the written quote, reservation confirmation, or service agreement for the specific booking. Customers should review those terms before authorizing payment. If the reservation document does not address a cancellation or rescheduling issue, contact ChiTown Trolley promptly for written clarification.
14. Third-Party Venues and Services
ChiTown Trolley is not responsible for the acts, omissions, rules, schedules, or restrictions of venues, hotels, event organizers, public authorities, parking facilities, or other third parties. Customers are responsible for confirming that pickup, loading, parking, and access arrangements are permitted at each location on the itinerary.
15. Text and Electronic Communications
By providing an email address or telephone number in connection with an inquiry or reservation, you authorize ChiTown Trolley to use those channels for service-related communications. Marketing text messages will be sent only as permitted by applicable law and your choices. Message and data rates may apply. You may opt out of marketing texts by replying STOP.
16. Intellectual Property
The ChiTown Trolley name, logos, website design, photographs, written content, and other materials on the website are owned by or licensed to ChiTown Trolley and are protected by applicable intellectual-property laws. You may view and use the website for personal or legitimate business inquiry purposes, but may not copy, republish, sell, modify, or exploit website content without permission except as allowed by law.
17. Third-Party Links
The website may link to third-party websites or services for convenience. ChiTown Trolley does not control and is not responsible for third-party content, privacy practices, availability, or services. Use of third-party services is subject to the terms of those providers.

19. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, ChiTown Trolley is not liable for indirect, incidental, special, or consequential damages arising solely from website use or from delays and disruptions caused by circumstances beyond our reasonable control. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from willful misconduct or other liability that applicable law does not permit us to disclaim.
20. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where federal law or another applicable law requires otherwise. Any dispute that is not resolved informally will be handled in a court of competent jurisdiction as permitted by applicable law and any controlling reservation agreement.
21. Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure by ChiTown Trolley to enforce a provision on one occasion does not waive the right to enforce that provision later.
22. Changes to These Terms
We may update these Terms from time to time. The version posted on the website will state its effective date. Changes to website terms apply prospectively. A reservation already confirmed remains subject to the reservation-specific terms in effect or agreed for that booking unless the parties agree otherwise in writing or a change is required by law.
